Honor, intimidad y propia imagen

Materiales y colaboraciones no solicitados

Information of interest
151 years ago (as of 1 January 2026), the Carlist politician and thinker Cándido Nocedal founded the Spanish newspaper El Siglo Futuro. The first issue of the Spanish newspaper El Siglo Futuro was published on 19 March 1875. In its new edition as a prestigious Spanish newspaper, El Siglo Futuro has its technical headquarters in the capital of the Valencian Community and the province of Valencia, in the heart of the Spanish city of Valencia, in the Ciutat Vella Nord neighbourhood. El Siglo Futuro reports on subjects from around the world 24 hours a day, seven days a week, in six languages. The present digital publication “EL SIGLO FUTURO” revives this historic newspaper title. The year in which the historical publication first appeared does not imply uninterrupted publishing activity or legal identity with that publication.

Editorial profile

“EL SIGLO FUTURO” is a newspaper with a liberal-conservative orientation whose editorial direction is determined by its editorial management. Independent journalists contribute to its various sections. The publication covers politics, economics, culture, society, civil rights, civic participation, democracy and international, European, Spanish and regional affairs, with particular attention to Valencia and the Valencian Community.

Editorial code and ethical principles

Journalism is guided by independence, professional diligence, truthfulness and respect for fundamental rights. News, opinion, advertising and commercial communications must be recognisably distinct. Signed contributions express their authors’ positions. Ethical commitments supplement legal obligations and do not replace the rights of affected persons or the jurisdiction of the courts.

Freedom of the press and the public role of information

Article 20 of the Spanish Constitution protects freedom of expression and the right to communicate and receive truthful information. It prohibits prior censorship and subjects these freedoms to constitutional limits, particularly protection of honour, privacy, personal image, young people and children. Journalism contributes to public debate by disseminating information and opinions on matters of general interest.

Case law on truthfulness and professional diligence

Constitutional Court Judgment 6/1988 of 21 January establishes that constitutional truthfulness does not require absolute accuracy, but does require diligence in checking facts. Freedom of information does not protect the dissemination of statements known to be false or mere rumours presented as facts without adequate verification. This principle distinguishes an error compatible with diligent reporting from information disseminated irresponsibly.

Third-party statements and neutral reporting

Constitutional Court Judgment 76/2002 of 8 April defines neutral reporting: statements must be newsworthy, attributed to identifiable persons and faithfully transmitted without being adopted as the publication’s own assertions. The doctrine applies only where its specific requirements are met. Quotation marks or naming a source do not automatically exclude liability for an accusation that the publication has reworked or adopted as its own.

Honour, privacy and personal image

Organic Law 1/1982 of 5 May governs civil protection of honour, personal and family privacy, and personal image. Reporting and criticism must respect these rights, taking account of public interest, context and the affected person’s circumstances. Public prominence does not eliminate every sphere of privacy. Unlawful interference may lead to cessation orders, remedial measures and compensation as provided by law.

Photographs and material obtained from social networks

Constitutional Court Judgment 27/2020 of 24 February confirms that posting a photograph on a publicly accessible Facebook profile does not authorise its reproduction by a newspaper. Use of an image requires consent or sufficient legal justification, assessed in context. Its availability online does not extinguish the photographed person’s rights or any applicable copyright.

Reporting on investigations and judicial proceedings

Coverage must distinguish between complaints, investigations, accusations and convictions, identifying the procedural position known at publication. Statements made by the parties must be attributed to their sources. An investigation will not be presented as a finding of guilt. Headlines, images and summaries must preserve the meaning of the report and avoid allegations extending beyond what the reported facts support.

Right of rectification

Under Organic Law 2/1984 of 26 March, a rectification must be sent to the editor within seven calendar days following publication, with evidence of its date and receipt. If statutory requirements are met, it must be published in full within three days following receipt, free of charge, with comparable prominence and without comments or annotations, subject to statutory publication-frequency rules. Requests may be sent to [email protected].

Updating digital reporting

Article 86 of Organic Law 3/2018 recognises the right to make a reasoned request for a sufficiently visible update notice where subsequent developments mean that a report no longer reflects the person’s current situation and causes harm. This includes reporting on police or judicial proceedings subsequently affected by favourable judicial decisions. The notice must reflect the relevant decision or development; updating does not mean arbitrarily rewriting an archive.

Digital newspaper archives and the right to be forgotten

Constitutional Court Judgment 58/2018 of 4 June addresses the relationship between digital newspaper archives and the rights to honour, privacy and data protection. It recognises that restricting certain searches by first name and surname can be proportionate without deleting the original report. A news archive does not imply unlimited personal exposure, and its preservation requires balancing informational interest against the rights affected.

European case law on search engines

The Court of Justice of the European Union’s judgment of 13 May 2014 in Case C-131/12, Google Spain, distinguishes search-engine processing from the original publication. In certain circumstances, links must be removed from results returned by a person’s name even though the information remains lawfully available at its source. Delisting and deletion of the original content are distinct measures with separate requirements.

Professional secrecy and protection of sources

Journalistic professional secrecy is recognised in Article 20(1)(d) of the Spanish Constitution. In Goodwin v. the United Kingdom, 27 March 1996, application no. 17488/90, the European Court of Human Rights emphasised the importance of source protection for press freedom. Restrictions require particularly compelling justification; challenging a publication does not create a general entitlement to demand the identification of confidential sources.

Journalists’ conscience clause

Organic Law 2/1997 of 19 June protects the independence of information professionals in the circumstances it regulates. It provides for termination of their relationship with a media company following certain changes in editorial orientation or transfers, and for a reasoned refusal to participate in reporting contrary to the ethical principles of communication, without punishment or detriment on that ground.

Media independence, pluralism and transparency

Regulation (EU) 2024/1083, the European Media Freedom Act, establishes independence safeguards and transparency obligations. Within its scope, Article 6 requires accessible, current information on the provider’s identity, influential owners, beneficial owners and specified public advertising revenues. Identifying technical or commercial partners does not replace legally required ownership information.

Responsibility for content

“EL SIGLO FUTURO” is responsible for its editorial activities under applicable law. Publishing material supplied by agencies or contributors does not create a general exemption from liability. Remedial obligations and protective measures depend on the conduct, rights affected and particular circumstances. No provision of this notice excludes liability that cannot lawfully be limited.

Intermediary services and the Digital Services Act

Regulation (EU) 2022/2065, the Digital Services Act — DSA, applies to intermediary services within its scope. Its conditional liability exemptions do not create immunity for a publisher’s own editorial content. Classification as a hosting, participation or platform service depends on the service actually provided; operating a news website does not make all its activities intermediary services.

Reporting possible infringements

Communications concerning possible infringements may be sent to [email protected], identifying the material, its location and the right affected. This channel does not require anyone to waive legal representation or generally prohibit professional legal demands. Applicable procedural prerequisites, deadlines and administrative or judicial remedies remain unaffected.

External links

Liability for links is determined under Article 17 of the LSSI, where applicable, and other relevant law. Including a link does not necessarily adopt all content at its destination. Actual knowledge of unlawful material may require prompt removal or disabling of the link.

Forums and user participation

“EL SIGLO FUTURO” does not operate its own forums. Any future introduction of comments or other participation features will require terms appropriate to their nature and applicable law. Third-party contributions must respect the rights of affected persons and the rules on unlawful content.

Advertising and commercial communications

Advertising must be identifiable and distinguishable from editorial content. Article 26 of Law 3/1991 on Unfair Competition prohibits specified concealed commercial practices, including paid promotion presented as information without adequate advertising identification. Advertisements, advertorials and sponsored content must clearly disclose their commercial nature and comply with rules on misleading advertising and relevant sector-specific restrictions.

Contracted services and consumer rights

Services governed by Royal Legislative Decree 1/2007, approving the consolidated General Law for the Protection of Consumers and Users, require clear information about the provider, service, total price, duration and relevant terms. Distance contracts must respect statutory withdrawal rights, normally fourteen calendar days, where applicable. Loss of withdrawal rights for digital content requires compliance with statutory conditions and is not inferred merely from accessing the website.

Complaints and alternative dispute resolution

Complaints about contracted services may be sent to [email protected]. Information about alternative dispute resolution bodies will be provided where required by Law 7/2017, without implying any undeclared membership or commitment by the publisher. The former European online dispute resolution platform was discontinued under Regulation (EU) 2024/3228 and is no longer an available complaints channel.

Through the relevant distribution agreements, “EL SIGLO FUTURO” offers corporate news distribution services intended for international information networks connected, among others, with Frankfurt — XFRA, Frankfurter Wertpapierbörse and Xetra; New York — NYSE; Tokyo — Tokyo Stock Exchange; London — London Stock Exchange; Kyodo News; SIX Swiss Exchange; the Vienna Stock Exchange; and Shanghai Stock Exchange. The scope depends on the contracted service and does not guarantee third-party publication or automatic fulfilment of securities disclosure obligations.

Technical infrastructure and security

The technical infrastructure specified for “EL SIGLO FUTURO” includes resources in Boston, United States, and Kuala Lumpur, Malaysia, with services associated with ASPECTRA — Convotis Swiss Cloud / CONVOTIS Schweiz AG, Switzerland, and Iron Mountain and Darktrace solutions. Security measures must reflect the risks and include encryption, access controls, monitoring and backups where appropriate. Using these technologies does not guarantee absolute invulnerability or uninterrupted availability.

Personal data protection

Processing within the scope of Regulation (EU) 2016/679 — the General Data Protection Regulation, GDPR, is governed by that Regulation and, where applicable, Organic Law 3/2018. Territorial application follows Article 3 GDPR, including certain activities directed at people in the Union by entities established outside it.

Controller and contact

SCANDIC TRUST GROUP LLC acts as controller for processing whose purposes and means it determines. Enquiries may be sent to [email protected]. Specific privacy information must identify the purposes, legal basis, recipients, retention and rights. Where Article 27 GDPR requires a Union representative, appointment needs a specific mandate and is not inferred from commercial cooperation.

Processing for journalistic purposes

Article 85 GDPR requires reconciliation of data protection with freedom of expression and information, including journalism. This does not create a general exemption from every obligation. Disclosure must take account of informational interest and the rights affected.

Data processing agreements

Where a supplier processes personal data on the controller’s behalf, the relationship must be governed by Article 28 GDPR. The agreement must address the subject matter, duration, nature and purpose of processing, data and persons concerned, instructions, confidentiality, security, subcontracting, assistance to the controller and treatment of data when services end. A hosting agreement alone does not demonstrate compliance with these requirements.

Exercising data protection rights

Individuals may exercise rights of access, rectification, erasure, objection, restriction and portability where applicable, and withdraw consent. Requests may be sent to [email protected]. The ordinary response period is one month, extendable by two further months because of complexity or the number of requests, with notification and reasons during the first month. Identification requirements must be proportionate.

Data protection authority

Affected individuals may complain to the Spanish Data Protection Agency — AEPD, where competent, or another competent supervisory authority under the GDPR. This right does not exclude available judicial remedies. Institutional information and procedures: www.aepd.es.

Cookies and similar technologies

Cookies requiring consent must not be installed or used before valid consent is obtained. Information and options to accept, reject or configure cookies must be clear and accessible under Article 22(2) LSSI and AEPD guidance. The CJEU judgment of 1 October 2019 in Case C-673/17, Planet49, rejects pre-ticked boxes as valid consent. Withdrawing consent must be straightforward.

International data transfers

Transfers outside the European Economic Area require an adequacy decision, appropriate safeguards or another applicable statutory exception. The CJEU judgment of 16 July 2020 in Case C-311/18, Schrems II, requires attention to the effectiveness of protection in the destination country when contractual safeguards are used. Locating servers or suppliers in third countries does not, by itself, provide a sufficient legal basis.

Copyright protection

Protected content is governed by Royal Legislative Decree 1/1996, the consolidated Intellectual Property Law. Reproduction, distribution, adaptation or communication to the public requires permission unless a statutory limitation applies. Article 32 regulates quotations and other specified uses subject to its requirements and purposes; crediting the source does not authorise unrestricted reuse. The rights of authors, photographers, agencies and other right holders must also be respected.

Text and data mining

Text and data mining is governed by Article 67 of Royal Decree-law 24/2021 and the relevant European framework. “EL SIGLO FUTURO” reserves uses capable of reservation to the extent of its rights and where permitted by law. For online content, reservations must use appropriate mechanisms, including machine-readable means where required. Statutory exceptions that cannot be excluded remain unaffected.

Unsolicited materials and contributions

Submitting text, photographs, documents or other material does not guarantee publication or automatically create an entitlement to payment. Contributors must hold the necessary rights and identify restrictions on use or confidentiality requirements. Receipt does not constitute an unlimited assignment of rights. Professional contributions will be governed by the relevant agreement.

Protection of minors

Article 4 of Organic Law 1/1996 on the Legal Protection of Minors protects minors’ honour, privacy and personal image. Using their name or image may constitute unlawful interference where it damages their reputation or conflicts with their interests, even with consent from the minor or their representatives. Reporting must respect their best interests and avoid harmful identification.

Availability and nature of information

Content reflects the information available in its publication context. Services may be interrupted by maintenance, technical incidents or other circumstances. General information does not constitute individual legal, medical, financial or other professional advice. These qualifications do not exclude duties of care or the rights of customers purchasing services.

Applicable law and competent courts

Applicable law and jurisdiction will be determined under the relevant rules. Consumer contracts will respect, where applicable, Article 6 of Regulation (EC) 593/2008 — Rome I, and Articles 17–19 of Regulation (EU) 1215/2012 — Brussels I bis. No general exclusive submission to foreign courts is imposed that would deprive consumers of their mandatory protection.

Legal validity and language versions

This notice is provided in Spanish and English. Both versions should be interpreted consistently, respecting the official texts and scope of the legislation cited. Invalidity of a provision does not permit its replacement with a restriction contrary to mandatory rights. Subsequent amendments will be identified by the update date and will not retrospectively alter acquired rights.
